Effective legal protection against new retroactive assaults on investors using safe non-EU countries. 

The fast-spreading wave of devastating retroactive tax and regulatory changes against PV investors across the EU is being made worse by:

  • no real recourse to national courts
  • a cynically unhelpful EU Commission
  • the toothless Energy Charter Treaty
  • high level of fragmentation of ownership
  • paper-tiger-style industry groups

Each new outrageous measure taken by an EU member state government appears to be inspiring and encouraging the next attack in another country.

How it works

The investment protection concept applied by ESH is based on the following:

  • experience gained with arbitration proceedings brought against Spain and the Czech Republic
  • the expected cancellation of Bilateral Investment Treaties (“BIT”) between EU member countries within the next two years
  • the aggregation of the largest possible volume of PV assets under the strongest available BIT between the country where the PV plant is located and a safe non-EU country.

Given the substantial cost of international arbitration economies of scale are crucial and therefore ESH will offer all investors in PV assets across the EU access to its defence platform.

This risk extends to all jurisdictions in the EU, including Germany, France and the UK. For increasingly desperate governments taking a lot of money from defenceless investors is too good an opportunity to pass. This is why these measures will keep spreading.

The most recent final dismantling of the support mechanism for PV plants in Spain and the consequential slaughter of equity investors and financing banks serves as the most relevant real-life example of things to come.
